About these terms

These Terms of Service ("Terms") govern your use of the SomeWine mobile application and website at somewine.app (together, the "Service"). By downloading the app or using the Service, you agree to these Terms.

The Service is operated by VTS Solutions, a company registered in the Netherlands (KVK 70168741), with its registered address at Breitnerlaan 62, 2391 GC Hazerswoude-dorp, The Netherlands.

If you do not agree with these Terms, do not use the Service.

Eligibility

You must be at least 18 years old (or the legal drinking age in your country, whichever is higher) to use SomeWine. By using the Service you confirm that you meet this requirement.

SomeWine is a wine education and cellar management tool. It is intended for adults who wish to learn about wine. We do not promote excessive alcohol consumption.

Your account

To access most features you will need to create an account. You are responsible for:

• Providing accurate information when registering
• Keeping your password secure and confidential
• All activity that occurs under your account

Notify us immediately at support@somewine.app if you suspect unauthorised access to your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we believe have been compromised.

Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law
• Post content that is defamatory, obscene, hateful, or harassing
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Upload or transmit malware, viruses, or any other harmful code
• Attempt to gain unauthorised access to any part of the Service or its related systems
• Scrape, crawl, or extract data from the Service by automated means without our written permission
• Interfere with or disrupt the integrity or performance of the Service
• Use the Service to send spam or unsolicited communications
• Circumvent any access controls or technical measures we implement

User content

You may post, upload, or submit content through the Service, including tasting notes, posts, comments, and wine label photos ("User Content"). You retain ownership of your User Content.

By submitting User Content you grant VTS Solutions a non-exclusive, worldwide, royalty-free licence to host, store, display, and distribute that content solely for the purpose of operating and improving the Service.

You are solely responsible for your User Content. You warrant that:

• You own or have the necessary rights to the content you submit
• Your content does not infringe any third-party intellectual property, privacy, or other rights
• Your content complies with these Terms and applicable law

We reserve the right to remove User Content that violates these Terms, without prior notice.

Intellectual property

All content provided by VTS Solutions (including the app design, wine database, AI-generated lessons, winery descriptions, and all associated software) is owned by or licensed to VTS Solutions and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, or create derivative works from our content without our prior written consent, except as strictly necessary for personal, non-commercial use of the Service.

AI-generated content

SomeWine uses AI (including Google Gemini) to generate wine identification results, tasting notes, and educational lessons. This content is provided for informational and educational purposes only.

AI-generated content may not always be accurate. Do not rely on it as a substitute for professional advice regarding wine valuation, allergen information, or health matters.

Third-party services

The Service integrates with third-party services (such as Apple's App Store). Your use of those services is governed by their own terms and privacy policies. We are not responsible for the content or practices of third-party services.

Availability

We aim to keep SomeWine available at all times but cannot guarantee uninterrupted access. We may suspend or restrict access for maintenance, security updates, or other operational reasons without prior notice.

We reserve the right to modify, discontinue, or retire any feature of the Service at any time.

Disclaimer of warranties

The Service is provided as-is and as-available without warranty of any kind, express or implied. To the fullest extent permitted by applicable law, VTS Solutions disclaims all warranties including, without limitation, warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be error-free, secure, or that identified wines, tasting notes, or pairings will be accurate or complete.

Limitation of liability

To the maximum extent permitted by Dutch and EU law, VTS Solutions will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to these Terms or the Service will not exceed the amount you paid us (if any) in the twelve months preceding the claim.

Termination

You may stop using the Service and delete your account at any time through the app settings.

We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. On termination, your right to use the Service ends immediately. The sections on intellectual property, disclaimers, limitation of liability, and governing law survive termination.

Governing law & disputes

These Terms are governed by Dutch law. Any disputes arising from or relating to these Terms or the Service shall be submitted to the exclusive jurisdiction of the competent court in The Hague, the Netherlands, unless mandatory consumer protection laws in your country of residence provide for a different forum.

If you are a consumer in the EU, you may also refer disputes to the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

Changes to these terms

We may update these Terms from time to time. When we make material changes we will notify you via a notice in the app or by email at least 14 days before the new terms take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
